You've got a MONTH-MONTH tenant in possession and want him to move-out, now what? California state law requires that the owner/landlord prepare and serve the tenant with a 60 day notice. The tenant has sixty (60) days in which to vacate the premises or face proceedings in unlawful detainer (lawsuit filed at court). May not be able to use in any rent-controlled city. See Calfironia's Code of Civil Procedure § 1161 and 1162.
